My theory on what exactly “The Loophole” is…
The Loophole is that the only person that can kill Jacob is his right hand man (Ben).
You probably say Ben isn’t the leader of the others anymore he has no control in the island.
Why? We see that the man in black from this point on I’ll call him “Pepe” put the idea into Richards head that John Locke is “special”.
Richard even made mention of it to Jack on how he has visited him 3 times already and there is nothing extraordinary about this man.
Let’s start from the beginning… Locke crashes on Island and has the ability to walk a power given to him by? Exactly it could be Jacob or it could be Pepe.
Word spreads to the others camp that a man who was a cripple now walks among us.
Word spreads to Richard that this mans name is John Locke a man he has visited on many occasions and has tried to persuade him to come to the island.
Richard see’s it as a sign from Jacob that the time to pass the torch has come.
Who’s to say that the list and instructions that Richard gives Ben are new they could have all been written out before the plane crashed.
So back to the story Locke finally comes to the others camp and Ben takes him to the cabin where he thinks Jacob has been residing Pepe then whispers help me and things start flying about.
Now jealousy begins to build in Ben not to mention Pepe may have been the one to give Ben the back tumor and caused the death of Alex.
So Ben feels he is no longer “special” in the eyes of Jacob and what does he do?
He steps down from the position it was not taken away he gave it to a man that is nothing.
So Ben is technically leader, we have yet to see how the torch is passed from leader to leader.
So back to the story at hand Pepe tells Richard to tell Locke about the compass, Locke travels through time, he dies, Pepe takes over his body then uses his influence to manipulate a battered and mentally broken Ben to kill the man that he serves so diligently.
Loophole revealed.
Sorry I started going on a tangent and towards the end decided to speed things up.
