So we all know that the lawyer threatening Kate turned out to be Ben's attorney. I know that there are plenty of people that believe that the whole thing was a hoax, but I don't. The scene where the lawyer tells ben all about Hurley's legal case was there to establish that he is in fact a real attorney.
In order to bring a custody case before the courts a biological relative must be the one to petition the courts. Claire's mom knows nothing about Aaron, and Thomas would have no reason to think that Kate's son is actually his baby....... unless.....
Ben and Thomas are the same person. Go back to season 1 and watch "Raised by Another". Thomas looks EXACTLY like a young Ben! You can even look it up using google images.
Wondering how this could be possible??? Well, I thought it was strange that Ben and Ms. Hawking seemed so familiar with each other, but perhaps they have met before. Ben also seemed very comfortable turning the Frozen Donkey Wheel, unlike John who seemed completely confused.
What if Ben turned the wheel the first time in, say 1984. He lands in Australia in 2003 (we know that there is one of those "special places" there because of Rose and Bernard). He meets Claire, dates her, and gets her pregnant. He is then informed that he must return to the island (this would explain his sudden change of heart about staying with Claire after it was too late for an abortion). He returns to the island with the help of Ms. Hawking. Four years later, in 1988, he steals a baby to fulfill his longing to be a father. When it is actually 2004 (both on island and in the real world) he hires a psychic to make sure that Claire boards flight 815.
Now, if Kate doesn't decide to return to the island like Ben wants her to, she will in fact lose Aaron because Ben will take his son from her. Let me know what you guys think! Theory by WNGYPSY
