Ok I will keep this brief, but it is profound.
Remember Red Shoes Guy, Hawking said that you can keep changing things over and over, but he will still die somehow.
Remember Charlie, Desmond can save him over and over and over with visions of the future, and technically for an eternity, KEEP SAVING HIM.
What if this stalemate between our two loopholios, Jacob and Mr. I'm Not Hungry, No Thanks, I don't want your Red Herring for supper.
Is simply some sort of Desmond-Charlie similarly set up thing.
Since there is a loophole one of them is trying to find, they obviously are both answering to someone else, a higher order, a higher "God" or a higher "truth." So I'm sure as we peel back this onion further, we will learn that there is something even more powerful than Jacob and smoke monsters, and ageless Richard with the million dollar haircut.
What if somehow in their stalemate one or the other, or both were either banished, or even better, KILLED and they found some way to avoid it by creating this time loop. I'm leaning toward one got killed or banished, and his scam is forcing the other to participate in this endless looping over and over, just like Desmond's ability to theoretically save Charlie every time for all of eternity.
For Charlie to live his full life, it technically is possible. Desmond just theoretically has to save him eternally. What if one day Desmond gets tired of saving Charlie, and wants him to die, and Charlie sets it up (some sort of loop or paradox) so that Desmond is FORCED to save him over and over, or else Desmond will die too. And Desmond is therefore, for all of his life, tied to Charlie at the hip so that he himself can stay alive. The "LOOPHOLE" therefore would be Desmond's ability to a) escape this eternal attachment to the hip while b) finally letting Charlie die as the universe/god's intended it all along.
So this Loophole with Jacob and TMIB could very well be the same thing. Jacob is banished/killed. He prevents his own death by symbiotically engaging in this endless loop, this endless battle using people, this symbolic backgammon game with TMIB or else TMIB falls with Jacob. They become attached at the hip. TMIB gets tired of the game, tired of ceaselessly forced to play, TMIB is looking for a loophole to a)escape this eternal game, escape this eternal tie to Jacob and b)finally finding a way for Jacob die while he himself can still live.
So, who do they both answer to? Who's the higher "god?" My bet, is that it's something we do not know of yet.
Also, I just thought of something neat. May or may not be true, but what if the opening scene of Season 6 is "Beep" i.e. the hatch Kroger grocery store check-stand grocery scan noise. But this time around it's Desmond typing 4,8,15,17,23,42. As in this loop's "incident" is different from the last, but is therefore rebalanced by new Valenzetti numbers so that the end result is the same, flight 815 still has to crash on the island. Just like the Red Shoe Guy always has to die, and just like Charlie always has to die, just the path to each's demise can be a little different each time. No matter how much you try to change the outcome, the universe will rebalance.
